Official Contest Rules and Regulations

Contest Description

  • 1. The ADVENTURE TRAVEL PHOTO CONTEST (the “Contest”) commences on July 1, 2009 at 12:01 AM PT and concludes on November 30, 2009 at 11:59 PM PT (the “Contest Period”). This Contest is sponsored by Adventure Collection, LLC (the “Sponsors”).

Eligibility

  • 2. The Contest is open only to legal residents of the fifty (50) United States, the District of Columbia and Canada, excluding the Province of Quebec, who are at least eighteen (18) years of age at the time of entry, who have photograph taking and sharing capabilities as of July 1, 2009. The Contest is not open to the following persons: (a) employees, agents, or representatives of the Sponsors, the subsidiaries of the Sponsors, suppliers providing prizes or other materials or services in connection with this Contest, including promotional agencies and marketing organizations, including the Contest Administrator, (collectively, the “Excluded Individuals”), (b) immediate family members of the Excluded Individuals, and (c) any other persons with whom the Excluded Individuals reside. “Immediate family” is defined as parents, siblings, children or spouse.

How To Enter

  • 3. Between July 1, 2009 and November 30, 2009, visit the official Contest web site at www.adventurecollection.com, fully complete the official Contest entry form and successfully upload your photo, and you will automatically be entered into the Contest for the Contest Period in which the entry was submitted.
  • 4. Limit one entry per person and/or per email address during each Contest Period.
  • 5. No purchase is necessary to enter this Contest.

Contest Periods

  • 6. Entries received during the contest will be deemed to be eligible for the Contest Periods which they were received:
    • a. Entries received between July 1, 2009 at 12:01AM PT and July 31, 2009 at 11:59 PM PT will be eligible for Contest Period 1.
    • b. Entries received between August 1, 2009 at 12:01AM PT and August 31, 2009 at 11:59 PM PT will be eligible for Contest Period 2.
    • c. Entries received between September 1, 2009 at 12:01AM PT and September 30, 2009 at 11:59 PM PT will be eligible for Contest Period 3.
    • d. Entries received between October 1, 2009 at 12:01AM PT and October 31, 2009 at 11:59 PM PT will be eligible for Contest Period 4.
    • e. Entries received between November 1, 2009 at 12:01AM PT and November 30, 2009 at 11:59 PM PT will be eligible for Contest Period 5.

Photo Contest

  • 7. Contest photo entries must contain adventure travel related content.
  • 8. Each Contest photo entry must not have a file size larger than ten (10) megabytes (MB).
  • 9. Each Contest photo entry must be the original creation of each entrant and must not contain any pre-existing, third party content. Third party content includes and is not limited to trademarks, brands, logos, images, visual effects and/or images that are not the property of the entrant. Each entry must be unique and not infringe the rights of any third party.
  • 10. Photo entries that include offensive content, commercial content that promotes anything other than the products or services offered by the Sponsors or have been published prior to or during the Contest Period will be disqualified at any point during the Contest Period at the sole discretion of the Sponsors. The Sponsors reserve the right to remove and/or report any inappropriate images for any reason.
  • 11. Contest entries must not contain content: where any persons are depicted to have taken excessive risks; that is inappropriate, indecent, obscene, violent, hateful, tortuous, defamatory, slanderous or libelous; that promotes racism or hatred against any group or individual or that promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; or that is unlawful, in violation of or contrary to the laws or regulations in the state or province where the photo was captured, produced or edited, as well as the laws and regulations of the United States and Canada.

Voting

  • 12. During each Contest Period, valid Contest photo entries will be able to receive votes on the Contest web site. Visitors and users of the Contest web site may vote at http://www.adventurecollection.com.
  • 13. All votes are subject to validation, acceptance and/or disqualification by the Sponsors.

Entry Selection and Judging

  • 14. After each Contest Period, the five (5) photo entries that received the most number of votes during that Contest Period will be selected for judging.
  • 15. Judges will evaluate all eligible photo entries for each Contest Period based on the following scoring system (the “Judging Score”):
    • Technical Quality (25%)
    • Aesthetic Composition (25%)
    • Creative Vision (25%)
    • Adventure Spirit (25%)
  • 16. The photo entry from each Contest Period which receives the greatest cumulative Judging Score will be deemed to be the winner of the Prize available for that Contest Period.

Prizes

  • 17. The following prizes (the “Prize” or “Prizes”) are available to be won in this Contest:
    • f. Contest Period 1 Prize: One (1) prize consisting of one (1) ten (10) day trip for two (2) aboard the National Geographic Explorer in the Galapagos Islands.     • g. Contest Period 2 Prize: One (1) prize consisting of one (1) six (6) day polar bear expedition trip for two (2) outside Churchill, Manitoba, Canada.     • h. Contest Period 3 Prize: One (1) prize consisting of one (1) six (6) day rafting trip for two (2) on the Main Salmon River in Idaho, USA. Visit http://www.oars.com/idaho/salmonriverrafting.html for more information. Approximate retail value of the Contest Period 3 Prize is USD $3,176.00.
    • i. Contest Period 4 Prize: One (1) prize consisting of one (1) six (6) day biking or walking trip two (2) in Czech Republic and Austria. The winner of the Contest Period 4 Prize may indicate their preference for the biking or walking trip, subject to availability.     • j. Contest Period 5 Prize: One (1) prize consisting of one (1) eight (8) days trip through Tibet for two (2). Visit http://www.geoex.com/adventure-travel/tibet/eight-days-in-tibet.asp for more information. Approximate retail value of the Contest Period 5 Prize is USD $3,590.00.
  • 18. Actual retail values will vary depending on dates selected and Prizes are subject to blackout dates and availability.
  • 19. Airfare for the Prize Winners and their respective Travel Partners is not included nor is part of any Prize available in this contest. Prize Winners and their respective Travel Partners are solely responsible for travel to and from their respective Prize’s departure point, ground transportation, taxes, transfers, spending money, tips, meals and any and all other charges not specifically mentioned as part of a Prize. All incremental costs in using or claiming a Prize not outlined in the Prize descriptions are the sole responsibility of the Prize Winners and their respective Travel Partners, including but not limited to: pre-trip and post-trip hotel stays, medical and travel related insurance, transportation, fuel, gasoline surcharges, beverages, food, gratuities, merchandise and all personal expenses of any kind or nature.
  • 20. Prize Winners and their respective Travel Partners are solely responsible for obtaining their own travel documents in advance of the redeeming a Prize. The Sponsors are not responsible in the event a Prize Winner or a respective Travel Partner is refused entry to destination or re-entry for whatever reason and any unused portion of a Prize will be forfeit. Prize Winners and their respective Travel Partners must travel together on the same itinerary.
  • 21. If a potential Prize winner cannot redeem a Prize for any reason, such potential Prize winner will be disqualified and an alternate winner will be selected in accordance with the “Judging” section of these Official Contest Rules and Regulations.
  • 22. The Sponsors do not assume responsibility for cancelled, delayed, suspended or rescheduled events after ticketing or scheduling a Prize for any reason whatsoever.
  • 23. The Prizes in this Contest must be accepted as described in these Official Contest Rules and Regulations and cannot be transferred, assigned, changed, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these Official Contest Rules and Regulations.
  • 24. All Prize trips must be redeemed by December 31, 2010.
  • 25. Limit of one (1) Prize awarded per person in this Contest.

Odds Of Winning

  • 26. The odds of winning a Prize in this Contest depend on the number and quality of entries received during each Contest Period.

General Rules

  • 27. To be eligible to be declared a winner of a prize, an eligible entrant must be a resident of the fifty (50) United States, the District of Columbia and Canada, excluding the Province of Quebec, who is at least eighteen (18) years of age at the time of entry.
  • 28. To be declared a Prize winner, a selected entrant must complete and sign an affidavit of eligibility, compliance and liability, and publicity release form which, among other things, confirms compliance with these rules, acceptance of the prize as awarded and release of certain parties from any and all losses, liabilities, damages or claims arising from or related to the prize awarded and the Contest itself. The selected entrants and their respective Travel Partners will have five (5) days to the completed eligibility, compliance and liability, and publicity forms. If a selected entrant does not return their Affidavit of Eligibility/Compliance and Liability/Publicity Release Form within five (5) days, the entrant will be declared ineligible and another entrant will be selected in accordance with these rules.
  • 29. For Canadian Residents only: In order to be declared a prize winner, a selected entrant who is a legal resident of Canada must complete and sign a Declaration and Release Form and correctly answer, unaided, a time-limited mathematical skill-testing question, without assistance or electronic aid, to be administered at a mutually convenient time over the telephone. There will be only one (1) opportunity to answer the mathematical skill-testing question. An eligible entrant who provides an incorrect answer will no longer be eligible to win a prize in this Contest. The selected entrants and their respective Travel Partners will have five (5) days to the completed eligibility, compliance and liability, and publicity forms. If a selected entrant does not return their Release & Indemnity Form within five (5) days, the entrant will be declared ineligible and another entrant will be selected in accordance with these rules.
  • 30. Each Contest entrant, by participating in this Contest, releases the Sponsors, the subsidiaries, affiliates, distributors and retailers of the Sponsors and affiliated merchants of each of the foregoing, suppliers providing Prizes or other materials or services in connection with this Contest, including promotional agencies and marketing organizations, including the Contest Administrator, and each of their respective officers, directors and employees (collectively, the “Releasees”) from any and all claims, liability, loss or damage whatsoever arising with respect to the Contest or the awarding, receipt, possession and/or use or misuse of any Prize and further acknowledges that none of the foregoing persons have made nor are responsible or liable for any warranty, representation or guarantee whatsoever in respect of any Prize or the quality, functionality or fitness for a particular purpose thereof.
  • 31. By participating in this Contest, entrants agree to be bound by these rules and all decisions of the Sponsors and Contest Administrator, which are final.
  • 32. All entries become the property of and will be verified by the Contest Sponsors, Judges and Administrator.
  • 33. All federal, state, provincial, local and other tax liabilities, including, but not limited to, sales and use taxes, excise taxes, income and withholding taxes, customs duties, fees and like amounts in connection with a Prize are the sole responsibility of the Prize winners and their respective Travel Partners.
  • 34. Prizes are not transferable or convertible to cash and must be accepted as awarded. Prizes may not be exactly as shown in promotional materials. In case of unavailability of any Prize or for any other reason the Sponsors, in their sole discretion, reserve the right to substitute a prize of equal or greater value.
  • 35. Each winner will be notified by the Contest Administrator and will receive their prize from the Sponsor. No correspondence will be entered into except with potential winners.
  • 36. By submitting an entry, entrants consent to the use of their photo entry and personal information, including name, photograph and/or Contest photo entry, without compensation, in any publicity carried out by the Sponsor or its agents or representatives.
  • 37. In the event that the Contest is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, including any errors in programming, printing, distribution or production errors or any other errors or other causes of any nature whatsoever beyond the reasonable control of the Sponsors and/or their agencies which corrupt or affect the administration, security, integrity or proper conduct of this Contest, the Sponsors reserve the right to terminate or suspend the Contest, in whole or in part, or modify it in any way at the Sponsors’ sole discretion, without advance notice.
  • 38. No responsibility is assumed by the Sponsors, their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, for any disruption to telephone network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof. The Sponsors assume no responsibility for lost, late, stolen, postage-due, misdirected, mutilated, incomplete or illegible entries, as well as any printing, administrative or other error of any kind in connection with this Contest. The Sponsors assume no responsibility or liability resulting from user attempts to participate in this Contest or, if required, download any information necessary to participate in this Contest.
  • 39. The Sponsors, in their sole discretion, reserve the right to disqualify any person suspected of tampering with the entry process or otherwise violating these rules. Sponsors further reserve the right to cancel, suspend, terminate or modify any promotion not capable of completion as planned, including unauthorized intervention, force majeure or technical failures of any sort beyond the reasonable control of Sponsors, which corrupts or impairs the administration, security, fairness or proper play of this promotion. Sponsors reserve the right, in their sole discretion, to suspend or terminate this promotion.
  • 40. By entering the Contest and voluntarily providing your personal information as described in these Official Contest Rules and Regulations, you agree to the collection, use and disclosure by the Sponsors and their representatives, promotional agencies and marketing organization of your personal information for the purpose of administering the Contest, including without limitation contacting entrants in respect of the Contest and disclosing the list of winners. Your personal information will not be used for any other purpose, nor will it otherwise be disclosed to third parties, unless otherwise required by law.
  • 41. This Contest and the terms and conditions contained in these Official Rules and Regulations shall be exclusively governed and construed in accordance with the laws of the State of California, the federal laws of the United States of America, the laws of the Province of Ontario and the federal laws of Canada, applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in the State of California.
  • 42. The Contest is subject to all applicable federal, state, provincial and local laws and regulations. Void where prohibited by law. This promotion is intended for viewing only in the fifty (50) United States, the District of Columbia and Canada, excluding the Province of Quebec, and shall only be construed and evaluated according to United States and Canadian law. You are not authorized to participate in the Contest if you are not a resident of the fifty (50) United States, the District of Columbia or the Province of Quebec.
  • 43. This Contest is subject to all applicable federal, state, provincial, local laws and regulations. Void where prohibited by law.

WINNERS LIST: For the complete winners list (available after January 1, 2010), mail a self-addressed stamped envelope to ADVENTURE TRAVEL PHOTO CONTEST WINNERS LIST REQUEST, 2269 Chestnut Street, #258, San Francisco, CA 94123, USA. Any requests for a winners list must be received by the Sponsor by January 31, 2010.
